Danucera Spa Regulations
§ 1. General Provisions
- This Regulations defines the rules for using services and purchasing products at Danucera Spa.
- Danucera Spa is operated by Danucera Spółka z ograniczoną odpowiedzialnością, entered into the National Court Register of Entrepreneurs under number 0001097617, NIP: 7011198587, REGON: 52827686800000, with its registered office in Warsaw (00-432), ul. Górnośląska 16 lok. 33
- The Regulations are available at the Salon and on the Entrepreneur's website.
- Making a Reservation, using a Service, purchasing a Product or a Gift Card means accepting these Regulations.
§ 2. Definitions
- Entrepreneur – Danucera Spółka z ograniczoną odpowiedzialnością, entered into the National Court Register of Entrepreneurs under number 0001097617, NIP: 7011198587, REGON: 528276868, with its registered office in Warsaw (00-432), ul. Górnośląska 16 lok. 33
- Salon – a brick-and-mortar service and sales point operating under the name Danucera Spa, address: ul. Piękna 5 lok. U2, 00-549 Warsaw.
- Client – a natural person using Services or purchasing Products or a Gift Card at the Salon.
- Minor – a client who has not reached the age of 18 and uses the Salon's services with the consent of a parent/legal guardian.
- Staff – persons employed by the Entrepreneur or cooperating with them on the basis of civil law contracts, performing activities related to the provision of Services or customer service at the Salon, in particular cosmetologists, massage therapists, hairdressers, and reception staff.
- Services – hairdressing, cosmetic, cosmetology services, and massages provided at the Salon.
- Products – goods offered for sale at the Salon.
- Price List – current list of prices for services and products available at the salon and on the website at www.danucera.pl, and in the case of Services – also in Booksy.
- Reservation – booking an appointment at the Salon.
- Booksy - a free application for booking appointments at the Salon, available at https://booksy.com/pl.
- Deposit – an amount paid upon Reservation, credited towards the price of the Service.
- Gift Card – a document (paper or electronic) enabling the use of a specified amount for Services or Products.
- Questionnaire – a form completed before selected Services (i.e., Bio Lifting, Hydrodiamond Treatment, Cryotherapy, Oxygen Infusion, Needle-Free Mesotherapy, Radiofrequency Treatment, PCA Chemical Peel, EVOLE, Danucera Luxury Massage, Premium Classic Therapy, Exclusive Sports Massage, MBR Pure Perfection 100N VIP Exclusive Nourishing, Anti-Wrinkle and Shaping Treatment, MBR Continueline Med Anti-Wrinkle and Desensitizing Treatment for Dry and Delicate Skin, MBR Men Oleosome Regenerating and Anti-Wrinkle Treatment for Men), containing questions, in particular, about the Client's health, the purpose of which is to determine contraindications or limitations to performing the Service and to ensure the safety of its performance.
- Privacy Policy – an information document specifying the rules for processing personal data by the Entrepreneur, available on the Website, at https://danucera.pl/pages/polityka-prywatnosci.
- Website – The Entrepreneur's Website available at www.danucera.pl and www.danucera.eu, including all subpages, including subpages related to DANUCERA SPA.
- Regulations – these SPA Salon regulations.
§ 3. Services Provided
- The Salon provides Services in accordance with the current Price List available at the Salon, on the website, and in Booksy.
- Services are performed only during the Salon's opening hours. Current operating hours are available at the Salon, on the website, and in Booksy.
- The Entrepreneur reserves the right to change opening hours, including temporary closure of the Salon, shortening or extending working hours for organizational reasons or reasons beyond the Entrepreneur's control.
- Before making a Reservation, the Client should familiarize themselves with the description of the Service, its scope, estimated duration, and price.
- The Client is obliged to follow the post-treatment recommendations provided by the Staff during or after the Service. Failure to follow the recommendations may affect the outcome of the Service.
§ 4. Products Offered
- The Salon only conducts retail sales of Products available in the current offer.
- Products are offered in quantities typical for retail sales and are intended for the Clients' own use.
- The current Product offer and their prices are available at the Salon in accordance with the obowiązującym Price List.
§ 5. Reservations and Deposit
- Reservations can be made:
a) online (via the Booksy platform),
b) by phone,
c) in person at the Salon. - The Entrepreneur may condition the maintenance of a Reservation on the payment of a Deposit. In the event of non-payment of the Deposit within 24 hours of making the Reservation, the Entrepreneur has the right to cancel the Reservation without further notice.
- The Deposit amounts to 20% of the service price according to the current Price List. In the case of prices given as a range, the deposit amount is calculated from the lower end of the range. The final deposit amount is always provided to the Client when making a reservation.
- For Reservations made via Booksy, information about the required Deposit, its amount, and payment method is displayed in the system before confirming the appointment, and payment is processed according to the functionalities provided by the platform.
- For telephone or in-person Reservations, information regarding the Deposit amount, method, and deadline for payment is provided to the Client via SMS.
- The Deposit is credited towards the price of the Service after its performance.
- Reservations can be canceled or rescheduled free of charge no later than 24 hours before the scheduled appointment time.
- In case of cancellation of an appointment, rescheduling later than 24 hours before the planned start of the Service, or the Client's no-show, the Deposit is non-refundable.
- In the event of non-performance of the contract by the Entrepreneur for reasons attributable to them, they undertake to refund the Client double the deposit amount, in accordance with Article 394 of the Civil Code.
§ 6. Rules for Service Provision
1. Client's Obligations
- The Client is obliged to arrive punctually for the appointment.
- Lateness may result in the Service being shortened without the right to a price reduction.
- In the event of a Client's lateness exceeding 15 minutes, if due to the specific nature of the Service it is not possible to perform it correctly in the remaining time, the Entrepreneur may cancel the appointment and retain the Deposit.
- Before performing selected Services that may affect the Client's health or require assessment of contraindications, the Client is obliged to complete a Questionnaire.
- The Client is obliged to inform the Staff about any health contraindications and to immediately report any deterioration of well-being during the performance of the Service.
- The Client is obliged to cooperate with the Staff in a manner that allows for the safe performance of the Service.
2. Refusal to Perform Service
- The Entrepreneur has the right to refuse to perform a Service or to interrupt it if:
a) there are health contraindications,
b) The Client refuses to complete the Questionnaire – in the case of a Service for which its completion is required in accordance with the Regulations.
c) the Client's behavior makes it impossible to perform the Service safely or in accordance with professional standards,
d) in the case of a Minor – there is no required consent from the legal representative or their presence, if required in accordance with the Regulations,
e) the Client is under the influence of alcohol, drugs, or other substances that may affect their behavior or the safety of the Client, Staff, or other persons present in the Salon.
- In the event of refusal before the start of the Service for reasons attributable to the Client – the Deposit is non-refundable.
- In the event of interruption of the Service during its performance for reasons attributable to the Client – the full price of the Service is due.
3. Staff Qualifications
- Services requiring special authorizations or qualifications, in particular treatments using specific devices, are performed only by persons with appropriate qualifications.
- The scope of Staff qualifications may vary depending on the type of Service.
§ 7. Minors
- Minors may use Services only to the extent appropriate for their age and taking into account the nature and specifics of the particular Service.
- Persons under 18 years of age may use Services only with the written consent of a parent or legal guardian.
- In the case of persons under 16 years of age, the Entrepreneur may require the presence of a guardian throughout the visit.
§ 8. Rules for Staying in the Salon
- Smoking tobacco and using electronic cigarettes and other nicotine products is strictly prohibited on the Salon premises.
- Video surveillance is conducted on the Salon premises. Surveillance only covers publicly accessible areas and does not include rooms where Clients' privacy could be violated (in particular, toilets and treatment rooms). Surveillance does not record sound.
- Recordings are stored for a period not longer than 30 days, unless they constitute evidence in proceedings – in which case, until their final conclusion. Detailed information regarding surveillance can be found in the Privacy Policy.
- The Client is obliged to refrain from behavior disturbing the peace of other Clients and the work of the Staff.
- For safety reasons, particularly the presence of chemical preparations and substances, treatment devices, hot and sharp tools, as well as slippery surfaces, children under 14 years of age are not permitted on the floor (zone) where treatments are performed.
- The restriction referred to in paragraph 1 serves to protect the health and safety of children and all Clients undergoing treatments.
- Minors present on the premises remain under the sole supervision of a parent or guardian, who is responsible for their safety.
- The Client is responsible for damages caused in the Salon, including damage to the Salon's equipment, which occurred due to the Client's fault. For damages caused by Minors due to their fault, their legal representatives (parent or legal guardian) are responsible.
- A wardrobe for outerwear is available in the Salon, which is not a storage facility for valuables.
- The Client is obliged to exercise due diligence and not to leave valuables or unnecessary items for using the Services unattended, in particular expensive jewelry, documents, and electronic equipment. The Entrepreneur is not responsible for their loss, destruction, or damage.
§ 9. Gift Cards
- Gift Cards are offered for purchase:
a) in-store at the Salon – for any amount,
b) online – in denominations set in the sales system, in particular from PLN 500 to PLN 2000, in PLN 500 increments. - Detailed rules for purchasing Gift Cards online, including payment terms, order fulfillment, and returns, are set out in the online store regulations available on the Entrepreneur's website at: https://danucera.pl/pages/regulamin.
- A gift card, within the meaning of applicable law, is not an electronic payment instrument, nor is it an electronic payment card.
- The validity period of the Gift Card is 12 months from the date of purchase.
- The Gift Card is a bearer instrument.
- The Gift Card can only be used for: cosmetology services, cosmetic services, and Products available at the Salon (according to the current Price List). The Gift Card cannot be used for hairdressing services or nail styling services.
- The Gift Card can be used for a transaction of equal or greater value than its nominal value.
- In case of a higher amount, the Client pays the difference.
- The Entrepreneur is not responsible for the loss, destruction, or damage of the Gift Card after it has been issued to the Client.
- The Gift Card cannot be exchanged for cash.
- The purchase of a Gift Card at the Salon is not subject to the right of withdrawal from the contract.
§ 10. Payments
- The Customer is obliged to pay the price in accordance with the Price List.
- The prices given in the Price List are gross prices.
- If a price range is indicated in the Price List, the final price depends on the scope of the service (in particular, duration, products used, and complexity) and falls within the specified range.
- Payment can be made by:
a) cash,
b) payment card,
c) Gift Card.
§ 11. Complaints
- Products purchased in-store are not subject to return or exchange due to a change of the Customer's decision.
- The above does not limit the Customer's rights to lodge a complaint in the case of:
a) a Product – if it is inconsistent with the contract,
b) a Service – if the Customer raises reservations about the manner of its performance or quality. - In the event of questioning a Service immediately after its performance, the Customer is not exempt from payment for the performed Service but has the right to lodge a complaint.
- The Customer should report reservations regarding the Service immediately after its performance, and if they arise later – no later than within 7 days from the date of the Service. Reporting a complaint after the expiry of the above deadline does not exclude the Consumer's rights arising from legal provisions, however, it may make it difficult to determine the legitimacy of the complaint.
- Complaints regarding Services and Products can be submitted:
a) in person at the Salon (by submitting a written notification)
b) by registered mail to the address of the Entrepreneur or the Salon,
c) by e-mail to: spa@danucera.pl
- The complaint notification should contain contact details, the date of the transaction or service performance, an indication of the type of Service or Product, and a detailed description of the reported reservations.
- To streamline the complaint process, the Customer may attach photographic documentation showing the effect of the performed Service or the condition of the Product. In the case of a complaint regarding a Service, the Entrepreneur may – if necessary to assess the legitimacy of the notification – ask the Customer to send additional photos or invite the Customer to the Salon for an inspection of the performed Service.
- You can find the complaint form in the attachments at the end of the Regulations. We encourage you to use the form as per Annex No. 1 to the Regulations.
- The Entrepreneur will provide a written response to the complaint within 14 days of its receipt, to the contact details provided by the Customer. If the Customer has provided an e-mail address and consented to electronic contact, the response may be provided in the form of an e-mail message.
- In the event of a recognized complaint, the Entrepreneur may – considering the nature and circumstances of the case – in particular:
a) replace the Product with one consistent with the Agreement,
b) perform a free improvement of the Service,
c) grant an appropriate price reduction,
d) return a corresponding part of the paid amount.
§ 12. Personal data
- The administrator of customers' personal data is the Entrepreneur.
- Detailed information on the processing of personal data, including purposes, legal bases, data retention period, and the rights of data subjects, is contained in the Privacy Policy made available by the Entrepreneur at the Salon and on the website.
- Personal data is processed in particular for the purpose of:
a) fulfilling Bookings and performing Services,
b) fulfilling legal obligations imposed on the Entrepreneur,
c) in the case of health-related data – solely based on the explicit consent of the Customer,
d) ensuring the security of persons and property, including through the use of video monitoring. - In the case of making Bookings via Booksy, personal data is also processed in accordance with the rules defined by the operator of that platform.
§ 13. Amendment of the Regulations
- The Entrepreneur may amend the Regulations only for important reasons, in particular in the event of:
a) changes in legal provisions,
b) changes in the scope or manner of providing Services,
c) organizational or technological changes affecting the rules of booking, payment, or performance of Services,
d) introduction of new Services or changes in the conditions of their offering.
Changes are published in the Salon and on the website.
- New provisions are binding from the moment of their publication in the Salon and disclosure to the public.
- The current version of the Regulations is always available at the Salon and on the Website.
- For bookings made before the change, the regulations in force on the day of the booking apply, unless the change is more favorable to the Customer or results directly from legal provisions.
§ 14. Final provisions
- Any disputes between the Salon and the Customer should be resolved amicably in the first instance.
- The applicable law is Polish law.
- In matters not regulated by these Regulations, the relevant provisions of generally applicable law shall apply.
- These regulations are effective from April 2, 2026.
